Set a foot provides an online marketplace for booking student services. Please note that Set a foot is an online marketplace and it does not itself provide the services directly to customers.

Furthermore, if you are using our platform to book your services, you are likely to be required to make a first service payment to your service provider via Set a foot (who will receive it on behalf of the service provider and then send it onto them). This first service payment is payable to your service provider and therefore is only repayable in accordance with your contractual rights to cancel, which are set out in clause 6.

1. Terms of the service

First time payment: means the amount of the first service payment due to be paid by the user to Set a foot (on behalf of the Service Provider).

Service Provider: means the provider of the service listed on the website.

Booking Confirmation: refers to the email sent by Set a foot to the user and service provider as soon as a booking request has been accepted by the relevant service provider.

Business Day: means any day other than a Saturday, Sunday or public holiday in Spain.

Future Payments: means all the future payments the user has to make directly to the service provider (in addition to the first service payment)

Security Deposit: means the amount that the user has to pay to the accommodation provider to cover any damages that occur during his occupation of the accommodation or any other breach by the user of the Tenancy Agreement. The deposit is refunded after move-out at the end of the Tenancy Agreement by the Accommodation Provider subject to deduction of any fee for damages. The Security Deposit is a matter between User and the Accommodation Provider and Set a foot is not involved in, and shall not be liable for the management of, any such deposits.

Service Fee: means the amount (inclusive of VAT) the user pays to Set a foot in respect of its fees when a booking is accepted in consideration of the services provided by Set a foot to the user. It is calculated by adding the fee of each service selected. This fee applies to the specific services displayed on the website.

Services: means the facilitation of bookings of accommodation, banking, mobile plans, transport and insurance services by users with service providers throughout the website

Tenancy Agreement: means the tenancy agreement, lease or license between the accommodation provider and the user in respect of the tenancy of the accommodation (apartment/residence)

Service agreement: means the agreement between the service provider and the user

Contract Start Date: Date in which the customer completes de checkout form, makes the payment and receives the confirmation order email.

These Terms of Service set out the terms on which we offer the Services and provide the Website and on which you agree to use the Services provided by us and the Website maintained by us.


2. Acceptance of Terms of Service

- By registering to use the Services and/or the Website on the Website, you accept and agree to be bound by these Terms of Service. These Terms of Service are only published in, and valid in, the English language.

- We may at any time modify these Terms of Service. We will notify you of any changes to these Terms of Service either by emailing you (at the email address entered by you into any form on the Website) or by posting a notice on the Website


3. Booking the Services

- Users are able to submit a Booking Request for the services through the Website

- The user guarantees that he is of legal age to enter into a contract such as a Tenancy Agreement or Service Agreement in the country where the service is located and acknowledges that Set a foot shall be entitled to retain any service fee that has been paid by the user as compensation for breach of this warranty by the user. It is the user’s responsibility to check that he can legally contract with the service provider

- Set a foot will promptly notify the user, by email, once a Booking Request has been accepted or rejected by the accommodation or service provider. If the Booking Request has been accepted, an acceptance email will be sent to both parties setting out the next steps.


4. First Service Payment

- The first rental payment is a contractual reservation fee payable by the user to Set a foot, which will receive it on behalf of the service provider and hold it on trust for the service provider.

- Set a foot is not a member of any deposit protection scheme in respect of such first rental payment and will not be holding any damages deposit or performance deposit for the service provider which they request from the user.


5. Full Service Payment

- The full service payment is a contractual reservation fee payable by the user to Set a foot, which will receive it on behalf of the service provider and hold it on trust for the service provider, that covers the full amount of the service fee (services that can be purchased for the full amount will be indicated on the website)

- Set a foot is not a member of any deposit protection scheme in respect of such first rental payment and will not be holding any damages deposit or performance deposit for the service provider which they request from the user.


6. Refund Policy

- Regarding the refund of the accommodation booking fee, each provider has their own Refund Policy, so Setafoot recommends to have a look at each providers website and get to know further information.

- For all the other services not related with accommodation bookings, the Client can get a full or partial refund (depending upon each personal case) during the first 30 days after purchasing the service.

- In order to proceed with the cancellation of the product order, you will need to email info@setafoot.com providing the following information:

   · Order number

            · Name and Last Name

            · Email


7. Billing and Account Information

- We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

- You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

- Set a foot has the right to report you to the police or other judicial body if Set a foot believes in its sole and absolute discretion that your conduct (whether in using the Website, our Services or otherwise) is unlawful.


8. Conduct

- In making any Booking Request and authorizing the Service Fee, first/full service payment (and the security holding, if applicable) in respect of selected Services, the user agrees that it shall not seek to circumvent Set a foot by trying to make (or in fact making) a booking with the service provider directly and notifying us that you have decided not to make a booking.

- By downloading and/or using the Website, you agree not to upload, post, email or otherwise send or transmit any material that contains viruses, Trojan horses, worms or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Services or Website.

- You agree not to interfere with the servers or networks connected to the Website or to violate any of the procedures, policies or regulations of networks connected to the Website, including these Terms of Service


9. Indemnification

- You agree to indemnify, defend and hold harmless Set a foot and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


10. Privacy

- You provide us with information when you register on the Website. We also collect information both relating to you (for example on your usage history and your preferences for certain kinds of offer) and to users of the Website and the Services in general. Any information that you submit or that we collect when you are using the Website or Services is subject to our Privacy Policy.


11. Disclaimer

- We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

- You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

- You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

- We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

- In no case shall Set a foot, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.


12. Agreement

- The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this website or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.


13. Termination

- Set a foot may change or discontinue the Services and/or Website at any time without prior notice. We reserve the right to terminate these Terms of Service for any reason, without notice, and these Terms of Service shall automatically terminate in the event that you violate any of the Terms of Service set forth herein (without prejudice to our accumulated rights against you). In the event of any termination, you will immediately cease use of the Services and Website.
